General Consultations

We provide general legal consultations to both intended parents and prospective carriers. Consultations cover the current law regarding gestational carrier arrangements, including the legal impact of using donated sperm or eggs.

We have extensive experience representing both intended parents and carriers. We regularly draft, review, and negotiate contracts between intended parents and carriers, and can assist with required or desired ancillary services by independent professionals, including counseling, background checks, and escrow services.

~~ As lawyers, we do not ourselves recruit or screen carriers, but work with multiple entities throughout the country that do so ~~

 

 

Working With Surrogacy Brokers & Agencies

~understanding and negotiating your contract with your broker or agency~

 

On behalf of intended parents, we review contracts with professional recruiters, brokers, and agencies; advise clients of the rights and obligations such contracts create; and negotiate appropriate revisions to minimize risks and protect clients' interests. 

 

Insurance Coverage

~understanding the financial risks and seeking a guarantee of coverage~

 

We review insurance policies to assess coverage for a carrier's maternity care and delivery expenses.   We may seek letters of coverage or may appeal denials of coverage where appropriate. In the majority of cases, we seek and obtain assurances of coverage prior to establishing a pregnancy. 

 

Parentage Of The Child

We regularly obtain pre-birth court orders to establish the paternity and maternity of the intended parents, including cases involving married same-sex couples, and couples using donor sperm or egg
